These Terms of Service ("Terms") govern your use of the Kindred Beacon mobile application ("Kindred Beacon," "the App," "the Service"), provided by Raul Sanchez, an individual doing business as Kindred Beacon ("we," "us," or "our"). By creating an account or using Kindred Beacon, you agree to these Terms. If you do not agree, do not use Kindred Beacon.
Kindred Beacon is a personal safety and location-sharing tool. It cannot guarantee your safety, prevent emergencies, ensure that alerts will be delivered, or ensure that trusted contacts or emergency services will respond. In an emergency, contact local emergency services when it is safe to do so.
Kindred Beacon is not a substitute for calling 911 (or your local emergency number), a security service, or a medical alert device. This version does not automatically send SMS or contact emergency services. Viewer links and reminders depend on device power, network connectivity, permissions, and a recipient opening a link you shared.
You must be at least 13 years old to use Kindred Beacon. If you are under 18, you confirm you have a parent or guardian's permission to use the App.
You're responsible for keeping your Sign in with Apple credentials secure and for all activity under your account.
Subscriptions are billed through Apple's App Store via StoreKit and auto-renew unless cancelled at least 24 hours before the current period ends. Manage or cancel in iOS Settings → your name → Subscriptions. Kindred Beacon cannot process cancellations or refunds directly — those go through Apple.
We have zero tolerance for objectionable content or abusive behavior of any kind, whether directed at a trusted contact, transmitted through a shared trip link, or otherwise connected to your use of Kindred Beacon. This includes harassment, threats, hate speech, sexual content involving minors, and any illegal or abusive content or conduct.
You agree not to: stalk, harass, monitor, or surveil another person without their knowledge and consent (including adding someone as a "trusted contact" without their agreement); send objectionable, abusive, threatening, or illegal content to a trusted contact or through the trip chat in either direction; use Fake Call, SafeWord, or any feature to deceive or defraud; access another user's account or data without authorization; interfere with or abuse Kindred Beacon's backend; or otherwise violate applicable law.
Reporting and enforcement: the app lets you report and immediately remove an objectionable message from a trusted contact directly from the trip chat, which also revokes that contact's access to your trip link. You can also report abuse to the support email in Section 14. We review and act on reports — including removing content and ejecting the offending party — within 24 hours. We may suspend or terminate any account that violates this section.
You retain ownership of the content you provide (trusted contact info, trip chat, Date Mode notes/photos). You grant us a limited license to store, process, and transmit that content solely to provide Kindred Beacon's features to you and the trusted contacts you choose to share it with. See the Privacy Policy for how this data is handled.
You may stop using Kindred Beacon and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms.
KINDRED BEACON IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT ANY ALERT OR MESSAGE WILL BE DELIVERED OR ACTED UPON, OR THAT ANY SAFETY FEATURE WILL PREVENT HARM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF SAFETY, LIFE, HEALTH, DATA, OR PROPERTY, ARISING FROM YOUR USE OF KINDRED BEACON. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) WHAT YOU PAID US IN THE PRIOR 12 MONTHS, OR (B) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. (Note: because Kindred Beacon currently operates as an individual rather than through a registered LLC or corporation, this cap and the disclaimers above don't create the same liability shield they would for an incorporated entity.)
You agree to indemnify and hold us harmless from claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of Kindred Beacon.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
We may update these Terms as Kindred Beacon evolves. Material changes will be reflected by updating the "Last updated" date above, and, where required, by additional notice in the app.
